Guilty Pleas Made During District Court Hearings

 

There were guilty pleas delivered during district court hearings held in Roosevelt County on Wednesday, Oct. 15.

Payton Brockie Brown made a guilty plea for criminal possession of dangerous drugs, Xanax.

Brown admitted that during a traffic stop on Sept. 10, law enforcement found Xanax in a pill bottle in her purse.

District Judge Benjamin Fosland ordered a pre sentencing investigation for Brown.

William Brooks Firemoon made a guilty plea to criminal possession of dangerous drugs, meth.

Firemoon admitted that he was a passenger during a traffic stop on Sept. 10. He was arrested on authority of a warrant at that time. During a search, a meth pipe was found in his pocket.

Fosland ordered a pre sentencing investigation for Firemoon.

Theodore James Crowe pleaded nolo contendere or no contest to misdemeanor assault. He admitted to physically assaulting a nurse in Culbertson. As part of a plea agreement, two other charges were dismissed.

Crowe was sentenced to six months in jail, none of the time was suspended. He wasn’t fined for the charge. He was given credit for 49 days served.

A bond hearing was conducted for Jason Daniel Daugherty. During a previous hearing, the plan was for Daugherty to attend a treatment center in California. Since that time, word was received that his insurance will not cover the service.

Daugherty has previously provided a $60,000 bond. Fosland released Daugherty until his trial, and the judge encouraged him to make sure he spends time with better people.

Kyle R. Fuchs denied three allegations that he violated the terms of his parole. The alleged violations included failure to report to his probation officer, a residence violation and lack of employment. A hearing was scheduled for Nov. 12. Defense attorney Sally Kay Hickok asked for a reduction of his $25,000 bond. She noted that Fuchs has a good construction job, his own home and is an Army veteran.

Fosland reduced the bond to $500. The judge encouraged Fuchs to stay in touch with his attorney.

Thea Jo Michaelsen had a dispositional hearing regarding violating her probation. For one case, Fosland reinstated a five year deferred imposition of sentence. For another case, Fosland revoked a four-year suspended sentence with the Montana Department of Corrections. The sentences were recommendation on a plea agreement. Michaelsen will remain on community supervision until being admitted for treatment.
