Various Cases Covered In District Court

District Judge David Cybulski adjusted the sentence for Lee Harrison Damm and presided over other cases during a full afternoon in district court on Wednesday, Jan. 13.

After hearing concerns whether Damm could complete both phase one and phase two of the sexual offender treatment program before being released from the Montana Department of Corrections, Cybulski modified the sentence so that Damm doesn’t need to complete both programs while being still in prison. Damm must be enrolled and work to complete the programs to the best of his ability. The sentence was for 15 years with 11 years suspended.

“I want to get him moving in the right direction for the long run,” Cybulski said.

Damm made a guilty plea to the charge of sexual intercourse without consent as part of a plea agreement on Thursday, Dec. 12.

In other cases:

•Donald Lee Fowler was fined $500 and received a suspended sentence of six months for criminal possession of drug paraphernalia.

•Lyle Patrick Larocque Jr., 32, made pleas of not guilty for strangulation, criminal endangerment, partner or family member assault and criminal mischief. The omnibus hearing was set for Feb. 10, and the trial was scheduled for April 15.

•Anthony Albert Sifuentes made not guilty pleas for intimidation, false reporting and disorderly conduct. The omnibus hearing was set for Feb. 10, and the trial was scheduled for April 15.

•Amanda Jo Marie Gourneau made a not guilty plea for criminal endangerment. The omnibus hearing was set for Feb. 10, and the trial was scheduled for April 15.

•Christopher Gustafson made not guilty pleas for two counts of criminal possession of dangerous drugs and one count of criminal possession of drug paraphernalia. The omnibus hearing was set for Feb. 10, and the trial was scheduled for April 15.

•Christopher Spillman was sentenced for criminal possession of dangerous drugs, a felony, during a hearing in district court on Wednesday, Jan. 21. He received a five-year deferred sentence and was fined $1,000. Credit for time served will go against the fine.
