Man Makes Guilty Pleas In District Court
David Allen Barton made guilty pleas to three misdemeanor charges during one of the hearings in Roosevelt County District Court on Tuesday, Oct. 27.
Barton, who wasn’t represented by an attorney, pleaded guilty to driving under the influence, third offense; driving while the privilege to do so is suspended or revoked, second offense; and driving without required motor vehicle insurance, second offense.
According to court documents, Barton was tested with a blood alcohol content of 0.094.
A sentencing hearing was scheduled for Nov. 24 at 2:15 p.m.
Penalties for the offenses included a minimum of 30 days and a maximum of one year and a fine between $2,000 and $5,000 for the first offense, a minimum of two days and a maximum of one year along with a $500 fine for the second offense, and a $350 fine for the third offense.
Also in District Court on Oct. 27, two individuals did not appear for hearings.
Jettison Leigh McClammy was scheduled to appear for a hearing on her bail. District Judge Benjamin Fosland explained that rather than issuing a warrant, he decided to have a hearing.
Defense attorney Phillip DeFelice said he was unsuccessful in trying to contact the defendant, but he added that the office of public defenders is behind because of an employee shortage.
Parties agreed to give McClammy two weeks to respond.
Lori Jo Lynn Grey Bear didn’t appear for her sentencing hearing.
Her hearing was rescheduled for Nov. 10 at 3
p.m.
