Trials For Deserly, Lester Moved To January

The trials for Abrianne Deserly and Calvin Lester Jr., who are facing second degree murder charges related to a death that occurred in Wolf Point on Feb. 26, has been continued until Jan. 6.

The jury trial will take place in Great Falls. The plea agreement/notice of intent to proceed deadline is Dec. 23. The motion is to continued was unopposed.

If convicted, Deserly and Lester face a maximum sentence of life in prison.

The brief in support of the motion states that Deserly’s counsel believes the trial in this matter is likely. The brief noted that the discovery file in this case is voluminous and features 528 files containing hundreds of pages of documents, as well as hundreds of gigabytes of audio and video files.

Video surveillance camera footages, including Deserly allegedly making purportedly incriminating statements, admissions or confessions in a public grocery store in the immediate hours after the death of the victim was disclosed to the defense on June 3. Dozens of hours of additional video surveillance footage taken from businesses surrounding the scene of the alleged crime have more recently been made available to the defense and are still being analyzed.

In addition, numerous items of physical evidence seized from the scene of the death are apparently stored at the tribal jail facility in Poplar and are being analyzed.
