Charges Dismissed Against Heser
The charges against Andrew Michael Heser in Roosevelt County District Court have been dismissed with prejudice.
Heser was facing the felony charge of criminal possession of dangerous drugs and the misdemeanor charge of criminal possession of drug paraphernalia.
In the motion to dismiss with prejudice document filed on Aug. 19, Roosevelt County Attorney Thomas Bleicher wrote, “The basis for this motion is that the defendant was able to seemingly remember that he is an enrolled member of the Little Shell Tribe of Chippewa Indians. The defendant provided proof of enrollment to the Roosevelt County Attorney’s Office. Since this alleged crime occurred within the boundaries of the Fort Peck Indian Reservation, the proper venue for this criminal matter is the Fort Peck Tribal Court.”
According to court records, a federal search warrant was executed on Heser’s residence in Wolf Point on June 6, 2025. The warrant was obtained after agents were able to identify the residence as a stash house for illegal narcotics used by Lucas Hamilton.
During the execution of the search warrant, agents recovered and seized two large sized vacuumed sealed baggies that contained methamphetamine residue inside of both baggies. The baggies were located in a trash can adjacent to a medium-sized safe.
On June 20, 2025, a BIA special agent and Fort Peck tribal narcotics officer conducted an interview with Heser. He admitted to keeping Hamilton’s safe at his residence. Heser said he was aware of the meth in the safe, but that he never had access to the safe. He later said that he was given money by Hamilton.
