Trials Continued For Deserly, Lester

The trials of Abrianne Deserly and Calvin Lester Jr. have been continued from the trial setting of July 8. The request, which had no objection, is for the setting’s date be extended for 90 days.

Both of the individuals from Wolf Point are facing second degree murder charges. They each made not guilty pleas in May. The indictment alleges that on Feb. 26, near Wolf Point, the defendants unlawfully and with malice aforethought, that is recklessly with extreme disregard for human life, killed John Doe, and aided and abetted the same.

The Federal Bureau of Investigation, Bureau of Indian Affairs, Fort Peck Tribes Department of Law & Justice and Roosevelt County Sheriff’s Office conducted the investigation.

Deserly’s brief in support of having the trial date moved included that her counsel believes that trial is likely. Discovery is ongoing including video surveillance camera footage that allegedly has Deserly making incriminating statements in a grocery store during the immediate hours after the death of the victim.

In addition, items of physical evidence seized from the scene of the death are still being analyzed.

The brief notes that the discovery file features 528 files containing hundreds of pages of documents as well as hundreds of gigabytes and video files.

The jury trial has been rescheduled for Oct. 7, in Great Falls.
