Sentencing Decisions Take Place In District Court
Brothers Calvin Mayo Jr. Corne and Cody James Corne were each sentenced during hearings held in District Court on Tuesday, Aug. 25.
Each of them were sentenced by District Judge Benjamin Fosland to 15 years with 10 years suspended for the count of criminal possession with intent to distribute. They were fined $2,500 for the charge.
In addition, they each received five-year deferred sentences for criminal possession of dangerous drugs. They were fined $1,500 for the charge.
The sentences were part of a joint agreement and will run concurrently.
When the arrests occurred on Feb. 10, law enforcement found close to a pound of suspected meth and 150 fentanyl pills.
Judge Fosland said the charges might had produced just probation sentences if it weren’t for the substances and the weight of the drugs involved.
Fosland told the defendants that he hopes they take advantages of some of the programs offered by the Department of Corrections.
The defendant’s father testified, “They are good kids. They work hard. I don’t want to see them sitting in jail. They do need some help. Rehab would be great for them.”
Cody said he is a good worker and has been attending church services. “My drug habit gets the best of me.”
Also during the hearings, Kristy Daugherty admitted to violating her probation by gambling or entering a casino. Her admittance was part of a plea agreement. A sentencing hearing was scheduled for Sept. 16.
Matthew Curtis Gustafson made not guilty pleas to the charges of possession of a dangerous weapon by a prisoner, tampering or fabricating evidence and criminal mischief.
Possible maximum penalties include not less than five years or more than 15 years and a fine of $50,000 for possession of a dangerous weapon by a prisoner and 10 years in prison and a $50,000 fine for tampering or fabricating evidence.
An omnibus hearing was scheduled for Oct. 27.
Dale Robert Fowler made not guilty pleas to the felony charge of criminal possession of dangerous drugs and misdemeanor charge of criminal possession of drug paraphernalia. Maximum penalties for the felony charge are five years in prison and a $5,000 fine. An omnibus hearing was scheduled for Sept. 29.
Fosland granted Fowler’s request to have his bond reduced to being released on his own recognizance. Fowler must submit to drugs tests three times a week.
The adjudication hearing for John David Panasuk was postponed to Sept. 16. Defense attorney Shannon Sweeney requested additional time to receive letters of recommendation and to conduct research.
