Overman Faces Drug Possession Charge
Joshua Lee Overman is facing three charges, including one felony, in district court.
The felony charge is criminal possession of dangerous drugs. Misdemeanor charges are criminal possession of drug paraphernalia and driving a motor vehicle while privilege to do so is suspended or revoked, second offense.
According to court documents, Overman was stopped for speeding and not having a functional license plate lamp on Feb. 3.
When the deputy went back to his patrol vehicle to run the occupant’s information, dispatch reported that Overman’s North Dakota license was suspended. The deputy ordered Overman out of the vehicle and told him that he was under arrest for driving while his license was suspended.
During a search of Overman for the arrest, the deputy discovered an unused methamphetamine pipe, used foil with black residue on it and four cigarette lighters.
A female passenger, who said she owned the vehicle, then gave permission to search the vehicle. Found during the search were two empty spray cans of electronics duster, a large torch lighter, a small baggie with a crystalline substance, a cut straw and an empty pen tube with white crystals on the end of it.
A deputy noted that the substance contained in the baggie was consistent in texture and appearance with meth. Weight of the substance was estimated to be about a half-gram.
After being read his Miranda rights, Overman was asked what the substance in the baggie was and he initially said he did not know. Later, he admitted that it was meth and it belonged to him.
