Fosland Presides Over District Court Hearings
District Judge Benjamin Fosland presided over four criminal hearings in Wolf Point on Wednesday, Feb. 11.
Shadey Ann Marie Wienke had her sentencing hearing for criminal possession of dangerous drugs.
Roosevelt County Attorney Thomas Bleicher made the recommendation that Wienke receives a three-year Department of Corrections commitment to run concurrently with two Lewis and Clark County cases. He said the sentence would allow Wienke to receive the treatment that she needs.
Defense attorney Sally Kay Hickok recommended a three-year suspended sentence to run concurrently with the Lewis and Clark County charges.
Fosland decided on a threeyear suspended sentence. In addition, the Department of Corrections has the authority for a year to put her into a treatment program. Wienke was given credit for 86 days time served.
T’shauna Lee Azure made not guilty pleas to the charges of criminal endangerment; reckless driving; failure to provide information, render aid; failure to give immediate notice of an accident; and no driver’s license.
An omnibus hearing was scheduled for March 24. Fosland denied a bond reduction unless he can be confident that she can stay away from alcohol or drugs while out of jail.
Anthony Douglas Miller made his initial appearance for a revocation of probation charge. If found guilty, Fosland could issue the maximum penalty of five years in the Montana State Prison and a $5,000 fine.
The alleged violations include using alcohol or illegal drugs. An adjudication hearing was scheduled for March 11.
Josiah Follet signed a waiver of extradition in order to be transported to North Dakota regarding an arrest warrant.
