Various Hearings Conducted In District Court Last Week
A sentencing, a change of plea and other hearings were conducted in front of District Judge Benjamin Fosland in Wolf Point on Tuesday, Sept. 23.
Brian Ray Gustafson was sentenced for the charge of possession of illegal drugs. His sentence was three years with the Department of Corrections to run consecutively with a charge in Richland County. He was also fined $2,000.
Fosland said he hopes the sentence will lead Gustafson to get his drug addiction under control.
Ryan Douglas Lien delivered a guilty plea to obstructing a peace officer.
Based on a plea agreement, he was sentenced to one day in jail. He was given credit for 31 days served. Fosland noted that the time served credit should cover any fines.
Breanna Luv Rahn-Lowe admitted to two counts of violating her parole conditions. She admitted to using alcohol or illegal drugs and not meeting with her probation officer.
Based on a joint recommendation, Rahn-Lowe was sentenced to 18 months with the Department of Corrections with none of the time suspended. She will be placed in a treatment center.
Anthony Douglas Miller changed his plea to guilty for criminal possession of dangerous drugs. A pre-sentencing investigation was ordered.
Jason Daniel Daugherty was granted release for a previously $60,000 bond. The agreement was that he will wear a drug patch and GPS tracker. He will attend and successfully complete a treatment center in California. He has a trial scheduled for December. Fosland warned Daugherty that if the requirements of his release aren’t met, a warrant will be issued for his arrest.
Lawrence Joseph Morin made a not guilty plea to the charge of aggravated DUI, third offense. If convicted of the charge, he faces maximum penalties of not less than 40 days or more than one year in jail, a $5,000 fine or both.
An omnibus hearing was scheduled for Nov. 12.
