Sentencing Hearings Conducted In District Court

Three sentencing hearings were among the action taken in Roosevelt County District Court in front of District Judge Benjamin Fosland on Tuesday, June 23.

Tshauna Azure was sentenced to a two-year commitment with the Montana Department of Corrections for criminal endangerment. The sentence was based on a joint recommendation by the state and defense.

Judge Fosland remarked that the two-year commitment will give Azure the opportunity to engage with some of the treatment opportunities available through the Department of Corrections.

She will be given credit for 175 days served.

Joshua Lee Overman received a three-year suspended sentence with the Department of Corrections for criminal possession of dangerous drugs. County Attorney Thomas Bleicher explained that Overman wasn’t eligible for a deferred sentence because of a previous felony conviction.

Fosland said he was concerned with Overman’s criminal history but added that most of the charges have been misdemeanors. Overman was given credit for 140 days for time served.

Xavier Jamal Christian Alvarado received a three-year suspended sentence for the o_ense of failure to register as a sexual or violent o_ender.

Fosland said he is aware of Alvarado’s criminal history. He told the defendant, “I encourage you to stay on the straight and narrow.”

Matthew Curtis Gustafson changed his plea to guilty for the charges of criminal possession of dangerous drugs, obstructing a peace ocer and criminal possession of drug paraphernalia.

Fosland ordered a pre-sentencing investigation for Gustafson.

Cody James Corne changed his plea to nolo contendere or no contest for the charges of criminal possession with the intent to distribute meth and criminal possession of dangerous drugs.

Bleicher explained that nearly a pound of meth and about 150 fentanyl pills were discovered in the vehicle when Corne was stopped near Bainville.

Fosland ordered a pre-sentencing investigation for Corne.

Theron Richard Hagadone admitted to violating terms of his probation including being in possession of alcohol or illegal drugs, a criminal charge in tribal court and participating in gambling.

A joint plea agreement called for Hagadone to have a four-year commitment with the Department of Corrections. He was given credit for 143 days served. Fosland agreed with the recommendation.
