Man Charged With One Felony, Misdemeanors
Stuart Murray Double is facing six charges including one felony in District Court for Roosevelt County.
The felony charge is criminal possession of dangerous drugs. Misdemeanor charges include criminal possession of drug paraphernalia, driving under the influence, operating a motor vehicle without liability insurance, driving without a valid drivers license and speeding.
According to court documents, the Montana Highway Patrol observed a brown pickup truck on April 23, traveling west on U.S. Highway 2 in Wolf Point at what appeared to be a high rate of speed. The vehicle was clocked at 55 miles per hour in a 25 mph zone. The trooper caught up to the vehicle and initiated a traffic stop.
Double, the driver of the vehicle, had none of the documents requested by the trooper.
Based off the driving behavior observed and the smell of marijuana coming from the vehicle and observations of Double, the trooper began to suspect that Double might be under the influence of an intoxicating drug and his ability to drive a vehicle safely had been impaired.
After field sobriety tests were conducted, the trooper placed Double under arrest, performed a full search incident prior to arrest, handcuff ed him in front of his body and placed him in the rear passenger seat of the patrol car.
The trooper applied for a DUI blood draw warrant. After the warrant was granted, Double was transported to Trinity Hospital in Wolf Point and a blood sample was obtained.
When counting the money in Double’s wallet, the trooper observed a small bindle in between the cash. The trooper opened it and observed what appeared to be methamphetamine in the bindle. The trooper seized the bindle and retrieved a methamphetamine NIK kit and tested the substance. The result of the test indicated a presumptive positive presence of methamphetamine.
Based on the information gathered from his investigation, the trooper began to suspect that Double might be selling drugs out of his hotel room in Wolf Point. The trooper obtained and executed a search warrant for the room where Double was staying.
Discovered during the search were a glass meth pipe, miscellaneous marijuana, uncounted 9 mm Luger ammunition and a black 9 mm Glock.
