Hearings Conducted In District Court

Change of pleas were among the hearings in Roosevelt County District Court in front of District Judge Benjamin Fosland on Tuesday, March 24.

Luis Manuel Alvarez Jr. changed his pleas to guilty for the amended charge of negligent endangerment, a misdemeanor, and theft under $1,500.

Based on a joint plea agreement, Alvarez was sentenced to one year in jail with all but 26 days suspended. He was given credit for 12 days served. He must complete the sentence within 60 days. He was fined $1,000. He was ordered to pay $650 in restitution to Roosevelt County for sign repair and $22 to Town Pump for a bottle of wine.

Joshua Lee Overman changed his plea to guilty for criminal possession of dangerous drugs and driving with a license that is either suspended or revoked. Fosland ordered a pre-sentencing investigation.

Jeremy Lee Boysun admitted to committing violations to his parole conditions. He originally received a fouryear deferred sentence for possession of dangerous drugs. Fosland reimposed the four-year deferred sentence. Boysun was also ordered to serve 20 days in the detention center during the next six months.

Matthew Curtis Gustafson made not guilty pleas to the charges of possession of dangerous drugs, obstructing a peace officer and criminal possession of drug paraphernalia. An omnibus hearing was scheduled for April 28.

Fosland reduced Gustafson’s bond to being released on his own recognizance. Gustafson is a father of four daughters and a local homeowner. Fosland said that as long as Gustafson stays sober and clean, there’s not much point of him sitting in jail. Gustafson was ordered to wear a drug patch.

Xavier Alvarado made not guilty pleas for failure to register as a sexual or violent offender and unlawful possession of a firearm. An omnibus hearing was scheduled for April 28. Fosland reduced Alvarado’s bond to $10,000. If bond is posted, Alvarado is prohibited from leaving Sheridan County.
