Hearings Conducted In District Court
District Judge Benjamin Fosland presided over several cases in Wolf Point on Wednesday, July 16.
Two of the hearings involved petitions for revocation.
Theron Richard Hagadone denied the allegation that he possessed or used alcohol or illegal drugs.
Hagadone originally had a three year deferred sentence for possession of drugs. An adjudication hearing was scheduled for July 29.
A motion was made that Hagadone could be released on his own recognizance. Public defender Michael Caldwell pointed out that Hagadone has three children to take care of. County Attorney Thomas Bleicher strongly opposed the motion, noting Hagadone’s criminal tribal history.
Hagadone has been on probation since December 2023.
Fosland said that he will note Bleicher’s objection but will grant the request for being released on his own recognizance. Hagadone needs to have drug testing performed three times a week.
Thea Jo Michaelsen denied two allegations of breaking her parole. The allegations include two counts of drug possession in Dawson County.
Michaelsen currently has a four-year deferred sentence and four-year suspended sentence. An adjudication hearing was set for Aug. 26.
Marlee Ann-Louise Schmitz made a no contest plea to one count of endangering the welfare of a child. She received a deferred sentence of six months and was fined $200.
Joseph Tod Ehrhardt waived his rights of extradition to face drug-related charges in North Dakota. He was arrested in Roosevelt County on a fugitive from justice complaint on July 14.
Anthony Douglas Miller made not guilty pleas to a felony count of possession of dangerous drugs, meth, and three misdemeanor charges of possession of drug paraphernalia. An omnibus hearing was scheduled for Aug. 13.
Public defender Cardwell requested that Miller’s bond be reduced from $25,000 to $5,000. Miller said he has a residence near the Roosevelt County Courthouse and has worked for a couple of different area employers.
Bleicher opposed the request, citing Miller’s criminal history that included arrests in Iowa and Wyoming.
Fosland granted the request for a reduction of bond. Miller must submit to drug testing three times a week.
